when some1 sits in spec when the map is over and the new map starts they still spawn while in spec and can kill ts and cts until they join a team.

You are saying that when the new map loads, and they click to join spectate, they spawn and are able to kill people, but once they go back to the team chooser and pick a team they can no longer kill people?

This is fixed in r409.
